SIMAIR737 – BOOKING TERMS & CONDITIONS

These Terms & Conditions apply to all bookings and flight experiences provided by SimAir737.

By making, retaining or attending a booking, the customer confirms that they have read, understood and accepted these Terms & Conditions.

1. ARRIVAL, GUESTS & LOCATION

1.1 Customers must bring their valid voucher or booking confirmation with them on the day of their experience.

1.2 On arrival, customers must wait in the designated seating area by the front entrance. The instructor will collect the customer no earlier than 10 minutes before the scheduled flight time.

1.3 Customers are responsible for arriving at the correct location and allowing sufficient time for parking and check-in.

1.4 Five passenger seats are available behind the pilots. Guests may attend and observe the experience, subject to available seating and any operational, safety or instructor requirements.

1.5 SimAir737 is located in the building directly to the left of the Terminal at Gloucestershire Airport. Free parking is available. Full directions are available at: www.simair737.com.

2. CANCELLATION, RESCHEDULING & NO-SHOWS

2.1 A minimum of 48 hours' notice must be provided to cancel or reschedule a confirmed booking.

2.2 Where less than 48 hours' notice is provided, SimAir737 reserves the right to charge a £25.00 rebooking fee where a rebooking is offered.

2.3 Failure to attend a confirmed booking, regardless of the reason, will constitute a no-show.

2.4 Following a no-show, SimAir737 may, at its discretion, offer a rebooking subject to payment of the £25.00 rebooking fee and availability.

2.5 Where a booking is missed without prior notice, SimAir737 reserves the right to treat the relevant flight entitlement and/or voucher as used, void and non-refundable.

2.6 Any decision by SimAir737 to waive or reduce a rebooking fee shall be discretionary and shall not create an entitlement or precedent in respect of any other booking.

3. TECHNICAL, SAFETY & OPERATIONAL ISSUES

3.1 The flight simulator comprises complex hardware, software and associated systems and may be affected by technical faults, software issues, equipment failure, maintenance requirements or other operational difficulties.

3.2 SimAir737 reserves the right to delay, amend, suspend, reschedule or cancel an

experience where reasonably necessary due to technical problems, maintenance, safety considerations or circumstances beyond its reasonable control.

3.3 Where SimAir737 is unable to provide the booked experience for such reasons, it will endeavour to offer an alternative date or time, subject to availability.

3.4 SimAir737 shall not be responsible for accommodation, travel, parking, loss of earnings or any other consequential or incidental costs incurred by a customer or guest in connection with a booking, except where liability cannot lawfully be excluded or limited.

3.5 Customers are advised not to make non-refundable travel or accommodation arrangements solely in reliance upon a particular flight time or date.

4. VOUCHER VALIDITY

4.1 The customer is responsible for ensuring that their voucher is valid on the date of the booked experience.

4.2 An expired, invalid or otherwise unusable voucher will not be accepted as payment unless SimAir737 expressly agrees otherwise.

4.3 Where an invalid voucher is presented, SimAir737 reserves the right to charge for the experience at a minimum rate of £1.70 per minute, payable before or on the day of the flight.

5. FLIGHT TIMES & LATE ARRIVALS

5.1 The scheduled start and finish times stated on the booking confirmation are fixed.

5.2 Customers are responsible for arriving in sufficient time to commence the experience at the scheduled start time.

5.3 Where a customer arrives late, SimAir737 will endeavour to provide the remaining available flight time; however, the experience will end at the originally scheduled finish time.

5.4 Time lost as a result of late arrival will not normally be added to the end of the experience, transferred to another booking or refunded.

6. PHOTOGRAPHY, VIDEO RECORDING & ELECTRONIC DEVICES

6.1 Personal video recording of the flight experience is strictly prohibited, including recording using mobile phones, cameras or other personal electronic devices.

6.2 Photography may be permitted solely at the discretion of the instructor and only where it does not interfere with the operation of the simulator, instructor duties, customer safety or any other operational requirement.

6.3 The instructor may prohibit photography or the use of any electronic device at any time where they consider this necessary for safety, operational or other legitimate reasons.

6.4 Customers and guests must comply with all reasonable instructions given by SimAir737 staff or instructors regarding photography, recording or electronic devices.

7. COCKPIT ACCESS, SEATING & PHYSICAL REQUIREMENTS

7.1 The simulator cockpit is a confined operational environment with restricted access and limited seating dimensions.

7.2 For safety and operational reasons, customers and guests must be capable of entering, occupying and exiting the cockpit safely and without causing obstruction or interfering with the operation of the simulator.

7.3 Where SimAir737 reasonably considers that an individual may be unable to safely access, occupy or exit the cockpit due to the physical limitations of the simulator,

SimAir737 may restrict or decline cockpit access where necessary for safety or operational reasons.

7.4 Customers who have concerns regarding their ability to access or occupy the cockpit are strongly advised to contact SimAir737 before booking or attending so that the physical dimensions and available arrangements can be discussed.

7.5 Any assessment concerning cockpit access or seating will be based on the individual's ability to safely use the available space and equipment and on the physical and operational limitations of the simulator.

7.6 Where appropriate, SimAir737 will consider reasonable adjustments or alternative arrangements, subject to the physical characteristics of the simulator and applicable safety requirements.

8. CUSTOMER & GUEST CONDUCT

8.1 Customers and guests must comply with all reasonable instructions given by SimAir737 staff and instructors.

8.2 SimAir737 reserves the right to refuse or terminate participation where a person's conduct creates a safety risk, materially interferes with the operation of the simulator, or constitutes inappropriate or abusive behaviour.

8.3 Where an experience is terminated for reasons attributable to the customer's or guest's conduct, any entitlement to a refund or rebooking will be determined in accordance with these Terms & Conditions and applicable law.

9. GENERAL

9.1 Bookings are subject to availability and are not confirmed until accepted by SimAir737.

9.2 SimAir737 reserves the right to make reasonable operational changes where necessary for safety, maintenance or the efficient operation of the experience.

9.3 These Terms & Conditions should be read together with any specific terms applying to the customer's voucher or booking. Where there is a conflict, the specific voucher or booking terms will apply to the extent of that conflict.

9.4 SimAir737 shall not be liable for any failure or delay in providing an experience caused by circumstances beyond its reasonable control.

9.5 Nothing in these Terms & Conditions is intended to exclude, restrict or limit any liability, consumer right or remedy that cannot lawfully be excluded, restricted or limited under applicable law.

10. ACCEPTANCE

10.1 By making, retaining or attending a booking, the customer confirms that they have had the opportunity to read and understand these Terms & Conditions and agree to be bound by them.
